“Welcome Letter”

Welcome to Elk Ridge!

We are happy you are our newest neighbor! The purpose of this letter is to provide some general information about “the community” and Homeowners Association (HOA).  Nothing in this document is intended to supercede the official Bylaws, Covenants Conditions & Restrictions, or any other official document you have received at the closing of your home.

Homeowners Association (HOA)

Congratulations, you now are 1 of 251 homes in the home owners association.  If you are renting, your landlord is 1 of 251 of the HOA.  A group of 251 people would have difficulty meeting and making decisions though, so as an owner, you are a member of the HOA with one vote. You are responsible for voting for a board of directors.  The board of directors is a group of up to 5 volunteers who are also members of the HOA, just like you, that are elected for 2 year terms.  In alternating years, 2 or 3 members come up for election.  All homeowners are encouraged to run for the board of directors and notification is given of upcoming elections via US Mail.  Frequently there is no election due to a lack of candidate volunteers, we are happy to have new board members with fresh ideas.   Serving on the board of directors requires 2-5 hours a month of volunteer service, the board receives no payment for their time and service to this community.  We welcome you to attend any of our meetings and ask questions.

The Board of Directors has set up a website, www.elkridgehoa.com, where we have links to the most important documents.  There is also a facebook page, facebook.com/ElkRidgeHOA, where we post more frequently, as well.   And there is a neighborhood posting board at nextdoor.com 

The board doesn’t provide official communications through nextdoor.com, but it is a great tool for neighbor to neighbor communication and neighborhood alerts.  The board does not endorse anything on nextdoor.com, it is just another communication tool for neighbors.  

Community Manager - Nicklin Community Management

Because the Board of Directors (BoD) for the HOA are volunteers and are only available sometimes, it is general practice in most HOAs of our size to hire a company to do the day to day management of the HOA.  More than likely you’ve already had some interactions with Nicklin Community Management, who has been managing Elk Ridge since 2008.  Nicklin is going to be the first point of contact for you to interact with the HOA.  

Nicklin collects dues and cut checks to pay all the bills for landscapers, electricity, water, as well as administers all inspections, maintenance and neighbor compliance with rules and regulations.   They also contact the gate company to get new residents added to the call box on the south side of the community, or for any breakdowns at the gates.  

Nicklin sends an inspector to make sure people aren’t letting the maintenance of their home decline on a monthly basis, and a letter is sent to the homeowner making them aware of the violation.

Dues & Payments

The monthly dues are $61, subject to change in the future, but dues have stayed constant for the last 5 years plus.  Payments can be sent to Nicklin CM at the address above.

Inspection Process, Courtesy Notes, Hearings, etc.

One of the core duties of the board of directors is to enforce the Covenants, Conditions & Restrictions (CC&Rs) that all the homeowners in the association receive in the closing process when they agree to purchase a home in an HOA.

The first step is identifying a violation.  This is typically achieved by either a report of a violation from a homeowner or by the inspector that the board engages through the community management company.  

When a violation has been identified, a courtesy note is sent to the homeowner requesting that the problem be addressed, and a return response be sent to Nicklin.  

If the violation continues to occur, the homeowner will be sent a hearing notice and be asked to appear at the next executive board meeting.  The hearing notice is sent via postal mail and has pictures of the violation under certain circumstances.

The board advises all homeowners to respond to the courtesy note or hearing notices in writing, via email, or via phone call to Nicklin.  If you don’t believe the violation is accurate, please notify the community manager so you can be reinspected and cleared.  It may be possible that the address has been written down incorrectly, transcribed incorrectly, or that the board will disagree with the person(s) that identified the violation.  If you need additional time to remedy the violation, request that time.  The board frequently grants additional time to remedy a violation when requested, but only if requested.  Email is the best way to correspond because it can easily be produced, and reviewed in the future, but any communication is better than the board not knowing your circumstances.  

If you elect to show up in person to respond to your hearing notice, please try to be brief and start by communicating what action you would like the board to take and follow it up with your justification for that action.  

The intent of the CC&Rs is to help maintain the beauty of the community and not allow a few homes to become a blight for all.   No one wants to receive a violation notice or especially a fine but HOAs are very common and it is important to understand how the process works when you live in one, or are new to and HOA.  

More information about the laws and powers that the HOA board has to impose fines is defined in Nevada Revised Statute 116.31031.

Some of the most common violations in our community:

Gates

We have vehicle and pedestrian gates at both the north and south entrances to the community.  Only the south entrance has a call box, so if you have guests visit they need to enter through the south entrance via the call box or gate code entry.  The north entrance is only for those people that have gate remotes provided by previous homeowner or Nicklin.

This gate entry key codes will change periodically and the change will be announced in the newsletter before it takes place.  You can buy a vehicle gate remote via Nicklin, or you can buy your own from Amazon or other places that sell them online.  The ones from the Nicklin are already programmed for our gates, but if you buy a compatible remote, they are fairly easy to program, but you do need some skills to make it happen.   Many homeowners have also programmed the universal remotes in their vehicles to open the gates so it is possible.  To get your name added to the call box directory, please contact Nicklin.  

Architectural Reviews

If you want to make a change to the outside of your home or property, you will need to get approval via an Architectural Review Committee submission and approval process.

Don’t assume that other changes, including paint colors, in the neighborhood have been approved, even if they have been there for a while. Unless it is replacing the original colors on the house when built, all paint colors MUST be approved prior to painting to avoid fines and repainting due to no approval from the Board.

While the architectural review committee (ARC) has 45 days to respond, typically we respond much quicker because we handle those by email rather than at meetings on the monthly schedule.  The representatives at Nicklin WILL NOT approve it.  It has to go to the ARC Review Committee, so please be patient, but do remind us if it has been to us for more than 7 days, or you are in a rush to avoid fines.

HOA Meetings

The BoD typically holds executive meetings on a monthly basis.  These are required for the hearings of violations that haven’t been resolved, or for discussion and action on fines and compliance.  These are closed meetings and only those homeowners called to a hearing are invited to attend the hearings portion of the meeting.  

There are also open meetings during which all homeowners are invited to attend.  There is an open comment period during these meetings for homeowners to be heard by the board on any issues relevant to HOA governance.

HOA Newsletters

The BoD sends a monthly newsletter to all the residents and homeowners to keep people informed of meetings, and any other information relevant to the community.  

Garage Sales

The board will typically grant permission for up to 2 community garage sales during the year if someone volunteers to put up and take down signs for the garage sale.  

Park Use

The parks are for the use of residents of the community.  There is no reservations of the park available.  Please be courteous to your neighbors and clean up after yourself as well as your pets.  Park equipment is maintained by Nicklin.  Should you see a damaged area, please report it to Nicklin for inspection.

Pets

All pets are required to be on a leash when they are outside your home or yard.  Free roaming pets, including cats, are not permitted.  You are also responsible for making sure your dogs don’t bark for extended periods of time, even when you aren’t home.  Please be courteous and clean up after your pets on the streets and in the park areas.

Speed limit

There is a 15 mph speed limit in the community.  Please slow down as there are many kids playing on the streets and safety of the children and residents is our main concern.

Street Sweeping

Street Sweeping is done on the 1st and 3rd Fridays of the month, every month.  Any vehicles left on the street are subject to possible towing, please move them into the driveways or garages overnight.

Towing

The HOA board prefers not to tow vehicles, unfortunately, it is unavoidable some times as vehicles are abandoned here on occasion.  We ask that you register your vehicles with the community manager so that we can send you a courtesy note, and even call you to a hearing before we have to resort to towing.  In the event that we can’t figure out who a vehicle belongs to though, we do have to tow sometimes.  The towing company we contract with will comply with state law and tag the vehicle for 48 hours before towing it.  Please do not let vehicles sit on the street unmoved for more than 24 hours at a time.  Should you need to store a vehicle please park in your driveway or garage to avoid a towing due to a resident complaint.

Maintenance Issues

If you see issues with the common areas,the gates, the security cameras, and  especially any immediate safety issues, please report them to the community manager ASAP so we can have them inspected and repaired.  

Trash Days

Trash pick up is on Mondays, regardless of whether it is a holiday.  Every other Monday is a bulk pick up day during which they will take items that aren’t in their blue cans.  Nov. 11, 2019 is a bulk pick up day.
